Terms of Service

1. Acceptance of Terms

By accessing or using PopRelay ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PopRelay is an email import service that retrieves emails from POP3 email servers and imports them into your Gmail account. The Service requires you to authenticate with your Google account and provide POP3 server credentials.

3. Account Requirements

To use PopRelay, you must:

  • Have a valid Google account
  • Be at least 18 years of age
  • Provide accurate and complete information
  • Have authorization to access the POP3 email accounts you configure
  • Subscribe to a paid plan to access sync features

4. Subscription and Billing

4.1 Plans and Pricing

We offer three subscription tiers: Solo, Pro, and Business. Each tier has different POP3 server limits and sync frequency options as described on our pricing page.

4.2 Billing

Subscriptions are billed in advance on a monthly or yearly interval, depending on the plan you choose. Payment is processed securely through PayPal. You authorize recurring billing for your selected interval.

4.3 Cancellation and Refunds

You may cancel your subscription at any time by clicking the "Cancel Subscription" button on the Settings page. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service until that date.

No refunds are provided for partial billing periods. Refund requests for other circumstances are handled on a case-by-case basis at our sole discretion. To request a refund, contact us at support@poprelay.net.

4.4 Plan Changes

You may change your plan at any time. Upgrades are processed through PayPal and typically activate once approved. Downgrades are scheduled to take effect at the end of your current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Access email accounts without proper authorization
  • Attempt to circumvent service limitations or security measures
  • Use the Service to send spam or conduct phishing attacks
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer or attempt to extract source code from the Service
  • Resell or redistribute the Service without authorization

6. Your Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • Ensuring you have the right to access the POP3 servers you configure
  • The content of emails transferred through our Service
  • Complying with the terms of service of your email providers
  • Any activity that occurs under your account

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

8. Intellectual Property

The Service, including its design, features, and content, is owned by PopRelay and protected by intellectual property laws. You retain ownership of your email content and data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPRELAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless PopRelay from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Your data will be handled in accordance with our Privacy Policy, including the data retention provisions described therein.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation or, if necessary, through binding arbitration or the appropriate courts.
